Domestic Violence

Joliet Domestic Violence Defense Lawyer

When a domestic battery complaint is made to the police, in most cases an arrest is made — it's typically the boyfriend or the husband who ends up in jail regardless of the circumstances. The police have a broad policy to take someone to jail in order to "diffuse" the situation.

If you've been arrested and charged with domestic battery, you are facing a mandatory conviction that stays on your record for the rest of your life. Not only is a jail sentence possible, but you will also lose your ability to ever legally possess a firearm. In some cases, child custody and visitation can be dramatically affected by the outcome of your case. Needless to say, you need an experienced attorney standing next to you in court.

I am Douglas G. DeBoer, an experienced domestic violence lawyer. I defend the rights and freedoms of people accused of domestic battery and other alleged crimes of violence.

Defending a Domestic Battery Charge

Many allegations of domestic violence or spousal abuse arise during a divorce or child custody battle, when one spouse seeks to gain an advantage over the other. The key to successfully defending these types of allegations is to identify what really happened.

My firm will closely review all of the evidence and interview other witnesses if it can help your case. I will then discuss your legal options, frankly and honestly.

In some cases, I may be able to negotiate to obtain a reduced charge of simple battery rather than one of domestic battery (which carries higher penalties). In other cases, it may make sense to vigorously defend the charge at trial.

Representation at Civil Hearings

Very often, the domestic battery charge is accompanied by an emergency order of protection. The emergency order is only temporary. A hearing is held within a few weeks from the date of the emergency order. During this hearing, the judge decides whether to enter a plenary order of protection that can have a dramatic affect on your life. The order will affect where you live, whether you can be with your family and whether you can possess a firearm.

You need the help of an attorney if you have been served with an order of protection.
